Richard Atkins QC – Tesco Fined £300,000 in National Prosecution

Richard Atkins QC  successfully prosecuted Tesco Stores Limited for their misleading pricing of strawberries across the country during the summer of 2011. Tesco Stores Limited entered guilty pleas to 4 offences of engaging in unfair commercial practices contrary to Regulations 5 and 9 of the Consumer Protection from Unfair Trading Regulations 2008 following 3 days of legal argument in which the prosecution successfully argued that Birmingham City Council could prosecute for offences occurring across the country and not simply within the Birmingham City boundary. This is the first time a Court has ruled on this issue under these regulations. Tesco Stores Limited admitted that they had mislead consumers in their pricing of strawberries which was contrary to pricing guidance issued by the Department for Business Innovation and Skills and has now been accepted by reason of their guilty pleas as being in contravention of the law. Tesco Stores Limited was fined £300,000 with the costs of the prosecution being recovered as well.
