Romana Canneti – Lachaux v Independent Print Limited and Another – Supreme Court

Romana Canneti was instructed (alongside Guy Vassall-Adams QC and Edward Craven of Matrix Chambers) by the Media Lawyers Association to intervene in the Supreme Court hearing of Lachaux v Independent Print Limited and Another [case ID UKSC 2017/0175]. The Appellants seek to overturn the Court of Appeal’s determination [[2017] EWCA Civ 1334] that the claimant’s reputation suffered “serious harm” under a threshold set by s.1(1) of the 2013 Defamation Act.

The Supreme Court granted the MLA permission to intervene in writing in this important preliminary issue test case, in which guidance is expected on the proper interpretation of the serious harm test; the circumstances in which serious harm can be inferred in the absence of evidence of harm; the applicability of the common law repetition rule and the admissibility of publications to similar effect.
