Alex Maunders - Successful stay of proceedings
Alex Maunders, instructed by Catherine Brymer & Beth Vaughan of Albin & Co, secured a stay of proceedings and offers of no evidence for a young person accused of aiding and abetting a serious assault.
This was a long running matter in which the young person suffered with severe difficulties. After several hearings on this issue Alex delivered robust submissions in his abuse of process application last week and judgment was reserved. In judgment Alex was complimented by the Judge on the submissions he had made, his sensitive representation, and the intensive work he had put into the case. The Judge noted that this was one of the exceptional cases where it was appropriate to stay the offence of aiding and abetting an assault occasioning actual bodily harm. The Crown offered no evidence in relation to the offences of unlawful wounding/inflicting grievous bodily harm and wounding/causing grievous bodily harm with intent.
