

On 26 March 2025, the Court of Appeal (Lady Chief Justice, President of the King’s Bench Division and Lord Justice Edis) heard the appeal from the decision of the High Court in Carter v Chief Constable of Essex Police [2024] EWHC 126 (KB) (Spencer J). The appeal concerned, among other matters, the proper interpretation of section 54(4) of the Police and Criminal Evidence Act 1984, the power of a custody officer to seize detainee clothing, in the context of the complete removal of a detainee’s clothing. Dr Daniel Wand of 4KBW led by Maya Sikand KC of Doughty Street Chambers appeared for the Appellant instructed by Kesar and Co Solicitors. Daniel appeared for Appellant in the High Court and in the County Court.
