

Janick Fielding secured at the Central Criminal Court the acquittal of an Albanian man accused of inflicting grievous bodily harm. The victim had been sharing a flat in which the defendant had been required to live as a condition of his release on bail for drug dealing offences. The victim claimed to have been both a customer and business associate of the defendant, whilst operating an illegal hairdressing enterprise during lockdown behind a shisha bar in Hounslow. The defendant had denied all knowledge of this and indeed of the victim himself. The victim asserted that he had been struck over the head with a rock, having been beaten by several men, including the defendant, for refusing to pay the totality of the rent. The defendant denied all knowledge of this as well. Despite having to change his solicitors and the details of his alibi defence, he was able to instruct Janick to persuade the jury, four years after his arrest, that there was at least doubt over his involvement. Janick secured the exclusion of late served tag data evidence that may have undermined his alibi just before the commencement of the trial and dealt with an investigating officer who was determined not to concede anything that might help the defendant. He was acquitted on all counts.
