Karen Staunton has successfully persuaded the Upper Tribunal that the First Tier Tribunal Judge who refused her client’s asylum appeal materially erred in law. At the conclusion of the contested error of law hearing, UTJ Kamara set aside the First Tier Tribunal Judge’s judgment in its entirety and remitted the matter for a de novo hearing. The matter concerned the treatment of new evidence submitted as part of a fresh claim and the application of the Devaseelan principles, as well as the application of the country guidance case of IA. The appeal was allowed on all grounds. Karen was instructed by Virgo Solicitors in both the First Tier and Upper Tribunal.
