Kirsty Day secures an acquittal for a client with significant cognitive difficulties.

The Defendant was accused of sexual activity with a child on four occasions – concerning kissing and cuddling her. The Defence case was that he had kissed the Complainant once on the cheek and that this was a friendly, non-sexual kiss as she was a family friend.

The Defendant had an IQ of 55 (an average IQ being 100) with diagnoses of Autism Spectrum Disorder, significant cognitive impairment and learning disabilities. The Defendant had an intermediary throughout his trial and the process took an incredible toll on his mental health.

This case required delicate and attentive client care for such a high needs Defendant.

Through measured cross examination of a child, her Mother, a teacher and a police officer as well as considered examination chief of the Defendant and a powerful, appropriately sensitive, closing speech, Kirsty successfully secured an acquittal of all matters for her client.
