Olive Lycourgou instructed by Walker Law secures a unanimous acquittal for a 52 year old male client accused of rape on an 18 year old homeless girl with ADHD and cystic fibrosis.

The girl had been sofa surfing and met the defendant at a party. He offered her a place to stay. She claimed that he took her phone away during her stay and had raped her. 

Olive prepared a phone schedule to show that the complainant had her phone with her texting her friend and father during her stay. Further cross examination revealed that she had been free to leave the address. 

The defendant accepted that he struck the complainant once when he tried to grab her phone during an argument however the phone was handed back to her straightaway. The prosecution alleged that the defendant had assaulted her before and after the rape and punched her numerous times despite the fact that the medical evidence was inconsistent with the violence alleged by the complainant. The jury returned a unanimous acquittal on the rape in 2 1/2 hours.
