Phil Anderson successfully represented a parent at a fact-finding hearing addressing allegations spanning 6 years in complex, highly litigious and lengthy Children Act proceedings

Phil Anderson instructed by Jane-Louise Burrows at Fullers Family Law successfully represented a parent at a fact-finding hearing addressing allegations spanning 6 years in complex, highly litigious and lengthy Children Act  proceedings. Findings were ultimately made against the other party that they had led the children make false allegations of child sexual abuse against Phil’s client and that they had done so purposefully to alienate the children. No findings were made against Phil’s client and specific findings were also made that they had not perpetrated domestic abuse. Relying on the recent CoA case of Re E (Children: Costs) EWCA Civ 183 Phil successfully argued that the litigation conduct of the other party had been unreasonable and reprehensible to the extent that a costs order was made covering 75% of his clients costs.
