Rhian Wood, instructed by Richard Brown of Baxter Brown McArthur Solicitors, secured a unanimous acquittal for her client facing a charge of grievous bodily harm (s20) against his brother.
The Defendant was accused of a prolonged and violent assault on his brother in their family home during which he was said to have forcibly twisted his brother’s arm and broken it.
Following careful review of the unused material, the jury heard about the numerous allegations the brother had made to the police in the years leading up to this offence, accusing the Defendant of harassing him, assaulting him and arguing with him with no further action taken. This alongside thorough cross-examination of the brother at trial revealed his true feelings towards the Defendant and demonstrated that in fact it was the brother who had attacked the Defendant and lied about it to the police.
