

Jenny has assisted Kesar and Co solicitors in securing significant damages in a long-running case against the Ministry of Justice concerning various breaches of the claimant's Article 8 rights.
The claim concerned numerous interferences over several years with the Claimant's correspondence, including unlawful interferences with the Claimant's legal correspondence (termed 'rule 39' correspondence under the Prison Rules).
Every issue was disputed by the Defendant, including remarkably whether or not the Claimant was a 'victim' within the meaning of the Human Rights Act 1998. Nevertheless, the Claimant secured significant damages in settlement at an unprecedented level when compared to existing case law.
