Adam instructed by Albin & Co secures the acquittal of a Solider accused of two counts of assault by penetration at Sheffield Crown Court.

It was alleged that the defendant had travelled to Barnsley to meet the complainant in a hotel room to get to know each other. The complainant alleged that she made clear to the defendant nothing sexual was to happen but despite that it was alleged that the defendant committed multiple offences. The defendant always maintained it was consensual between the pair of them and when she asked him to stop he did.

Adam’s extensive cross examination of the complainant demonstrated inconsistencies within her account as well as matters which she had omitted from her account to police. Whereas the defendant had provided a consistent account throughout.

After 4 days of trial the Jury returned unanimous Not Guilty verdicts on both counts meaning the defendant was free to carry on serving in the army.
