Nadia Chbat, secures another acquittal, for her client accused of Rape. Instructed by Paul Gilmartin of Albin & co Solicitors, the defendant denied any sexual contact.
The Crown’s case involved a report to the police with text messages from the defendant apologising for his behaviour. The defendant was adamant there were further phone messages between them. During the cross examination of her client, Nadia made an application, for the Crown to carry out a further download from her clients phone handset.
The handset download revealed messages not found on the Aceso downloads from both phones.
The complainant was recalled and further cross examination by Nadia, demonstrated to the jury there had been deleted texts by the complainant before she called the police. The defendant was unanimously acquitted within 2 1/2 hours.
