Not guilty verdicts in a rape and assault by penetration trial for Clare Evans at Reading Crown Court instructed by Rob Jacques at Reeds solicitors.

The complainant and the defendant, old school friends,  fell asleep together in the same bed after a social gathering, neither was drunk.  The complainant said she woke up to hear the defendant asking if he could ejaculate inside her. She had not felt the defendant pulling down her shorts or penetrating her, first with his fingers and then with his penis. Of course, all of this information came from the defendant who gave a full comment interview during his second interview after a trace of his DNA (semen) was found on the complainant's underpants. The complainant was 18 at the time of the incident, the defendant 19. A fantastic win for Clare and her client, but a dreadful situation for both of these young people who have had to wait for nearly 3 years for this trial to be heard.
